Activating protocol of cooperation between the Egyptian Customs Authority and the General Organization for Export and Import Control

     Facilitating international trade movement requires more cooperation and consolidation of efforts of all parties involved in dealing with commodities in the international trade supply chain, especially government agencies. To achieve this goal, a protocol of cooperation was concluded between the Egyptian Customs Authority and the General Organization for Export and Import Control to activate the Authorized Economic Operator Program, Egypt.

    The following is an interpretive statement of how to activate the items of this Protocol by both parties:

     First: Regarding the first item of the Protocol:

    This item states that the introductory preamble of the Protocol is a summary of the general objectives for which this Protocol has been  concluded. The following items shall be considered as an implementation plan for the achievement of these objectives and shall be abided by both Parties through continuous coordination, provided that each entity in its field of work takes into account what concerns them of enforceable legislations, and that any criteria for companies accreditation shall be the responsibility of both parties in every aspect (establishment - execution- Follow-up .) .

     Second: Regarding the second item of the Protocol:

    (As for the Customs Authority - Authorized Economic Operator service):

    • Each customs zone director shall select the members of the committee referred to in this item from customs side “depending on the operational capacity in the zone and its administrative organization” and, if necessary, more than one committee may be formed, and the Customs Department shall provide the necessary number of members to speed up the procedures and not interrupt work by any means.
    • The Committee shall finalize all release procedures of imported and exported lots for AEO Egypt customers in accordance with the procedures publication items  51/2013 and other legislations of the concerned common entities in light of the applicable risk program, through using advanced detection devices, exchanging information with the latest available means, and coordinating with all concerned parties.

     (As for the General Organization for Export and Import Control ):

    • The GOEIC shall give priority to the customers of the Authorized Economic Operator service(AEO) Egypt to facilitate and expedite the completion of the applicable executive procedures by selecting members from the competent branch or assigning additional tasks, depending on the operational capacity of the branch and administrative organization in each zone in accordance with the regulations and legislations in similar cases to accomplish the tasks in order to participate in the concerned joint commission.
    • The GOEIC shall, in cooperation with the Authority, study and implement the best possible solutions to provide the available techniques and means to ensure a good and rapid information exchange environment in the work field, including linking the required and agreed upon data of GOEIC with the ports, with the potential of rapid correction of errors made during insertion, if any.

     Third: Regarding the third item of the Protocol:

    (As for the customs authority - Authorized Economic Operator service):

    • If the customer preferred to apply the pre-release system, the General Administration of Customers at the AEO service Egypt shall inform the customer of the necessity of providing GOEIC with the complete documents of the shipment so that  GOEIC takes its documentary procedures before arrival of commodities.
    • Customer shall provide copies of complete documents for the lot (invoice, package list, analysis or inspection certificate . ) immediately after commodities  shipping in following of the pre-release system procedures that is currently applied in customs, in order for GOEIC to take the necessary procedures regarding these commodities and to prepare for conducting a conformity check upon arrival of the shipment after the completion of the necessary laboratory tests, if any; reducing the release time.
    • cooperating and coordinating between both parties for the enablement of  virtual inspection performed by GOEIC on incoming lots of non-food industrial commodities that meet the requirements developed by GOEIC regarding this procedure.
    • Cooperating and coordinating between both parties for the enablement of prior examination performed by GOEIC on exported lots that meet the requirements developed by the GOEIC regarding this procedure.

    (As for the General Organization for Export and Import Control ):

    • Upon completion of all required documents related to the customer, GOEIC shall complete the actual examination procedures (both virtual and/or laboratory) within minimum time limits set forth in the applicable laws and legislations.

     Fourth: Regarding the fourth item of the Protocol:

    (As for the customs authority - Authorized Economic Operator service and the General Organization for Export and Import Control as well):

    • Both parties identified a point of contact until the automatic connection between the two parties is completed. As for the Economic Operator of the Customs Authority, the point of contact will be (the General department of operations within the Economic Operator located at the third floor of Ministry of Finance towers). For the General Organization for of Export and Import Control, the point of contact shall be the call center and citizen service in the main branch at the airport).
    • AEO Egypt service assumes:
      • Exchange of information of customer database.
      • Notify GOEIC if there is any modification in lists of customers approved within the service, either by registering new customers, suspension, or cancellation of customers who are already registered in the service, accompanied by the reasons of suspension or cancellation and both parties shall abide by such modification.
      • Mutual notification between both parties about any violations or reports recorded against any member customer registered in the service .
      • Notify the other party about mutual recognition agreements that are concluded to be announced to customers.
      • Notify the GOEIC about problems that cannot be solved with the persons in charge of areas, in order to report them to the leaders to quickly reach a decision for such problems.
      • Exchange of correspondences that include matters common to both parties such as holding workshops or discussing new ideas to improve work and procedures.etc.
      • Commitment to provide the requirements of subsequent technical review and allow GOEIC employees of to access them at the  headquarters if the company is subject to a quality system.

    Fifth: Regarding the fifth item of the Protocol:

    (As for the Customs Authority - Authorized Economic Operator service):

    • Coordination and follow-up through AEO, Egypt service and Technology Departments of Authority in order to achieve automatic connection between all outlets as well as with all governmental bodies concerned with procedures of import and export starting from the General Organization for Export and Import Control (Single Window Model) and the justice that will be provided by such automation in dealing with customers in terms of itemization and assessment, providing information in quantity and quality for the body that needs such information in a timely manner and saving time and effort to the customer and employees of such authorities.
    • Prepare a serious study to establish a common risk management system that includes all governmental bodies concerned with import and export procedures, taking into consideration that determining the level of risk management (in technical matters) is subject to the sole discretion of GOEIC or the multiple bodies that are under the supervision of GOEIC.

    (As for the General Organization for Export and Import Control ):

    • GOEIC shall cooperate with the Authority in the field of automated information connection with customs outlets whenever the means and techniques to do such are available, with both parties participation, and on the basis of amending the executive procedures within limits of legal and legislative interpretations and the available potentials.

    Sixth: Regarding the sixth item of the Protocol:

    (As for the customs authority - Authorized Economic Operator service):

    • AEO Egypt shall notify its customers about the statement of the countries that have entered into mutual recognition agreements under conformity certificates with the Authority so that companies joining the service can benefit from the implementation of the items of those agreements.
    • After completion of all stages of establishing the AEO Egypt program and obtaining approval from the World Customs Organization (WCO), the Customs departments of the WCO Member States will be invited to conclude mutual recognition agreements between AEO Egypt and AEO programs of those countries, so that the approved companies can benefit from this advantage when exporting or importing to and from those countries without prejudice to the legislations regulating the work of the parties involved in the service (future stage).

     (As for the General Organization for Export and Import Control ):

    • GOEIC shall also apply enforceable laws and decisions upon the inspection of imports and exports of customers registered in the service.
    • GOEIC shall notify the Authority about any updates that would facilitate the international trade movement in general, such as mutual recognition agreements for conformity certificates or any other protocols concluded between GOEIC and competent authorities in other countries.

    Seventh: Regarding the seventh item of the Protocol:(Formation of the joint committee between both parties and its tasks)

    (As for the Customs Authority - Authorized Economic Operator service):

     The Committee shall be formed from the Customs side headed by Mr. Senior Deputy Minister, the head of Customs Authority, and the membership of each of the following:

    • Head of the Central Administration for the Authorized Economic Operator (AEO) service in Egypt (Vice Chairman)
    • General Manager of General Administration for Operations of AEO service Egypt (Member)
    • General Manager of General Administration for Customers of AEO service Egypt (Member)
    • General Manager of General Administration for Commitment of AEO service Egypt (Member)
    • General Manager of General Administration for Follow-up and Assessment of AEO service Egypt (Member)
    • Manager of Technical Office of the AEO service Egypt Chairman (Member)

     As for the General Organization for Export and Import Control):

    The Committee shall be formed by the GOEIC headed by Mr. Chairman of GOEIC and the membership of each of the following:

    • Head of Central Administration for the Office of Chairman of GOEIC (Vice Chairman)
    • Person in charge of food imports (Member)
    • Person in charge of industrial imports (Member)
    • Person in charge of exports department (Member)
    • Person in charge of IT (member)
    • Committee coordinator (member)

     Eighth: Regarding the eighth item of the Protocol:

     (As for the Authorized Economic Operator by both parties):

    • The Committee referred to in the aforementioned item shall meet periodically every three calendar months, taking into consideration the determination of the date and place of the next committee meeting at the end of each session held.
    • The Vice Chairman of the Committee on the Customs side shall present a report on the customs performance in relation to the activation of the Protocol.
    • The Vice-Chairman of the Committee of the GOEIC side shall submit a report on GOEIC performance in relation to the activation of the Protocol, as well as identifying the shortcomings and ways to overcome them.
    • At the end of each meeting, after discussing the common issues related to the activation of the Protocol and problems of customers, the Committee shall make the necessary recommendations for improving the performance, and discuss actions taken to execute such recommendations at the beginning of the next meeting of the Committee.
    • Upon practical and proven success of Protocol implementation, the heads of both parties shall be committed to send a joint memorandum to both competent ministers to enact a binding ministerial resolution concerning that matter.
