Service description

• Cancellation of agency contracts in the commercial agent's registry in accordance with Law 120 /1982
• Cancellation of the agency contract in the agent's registry is of two types
  • Write-off at the request of the agent
  • Or cancel or terminate the agency contract at the request of the principal

First, documents and procedures for canceling the agency contract at the request of the agent

A- Documents written off the contract at the request of the agent

1. Fulfilling the request to cancel the contract signed before the competent employee of the person concerned, or of those who have the right to manage and sign, or from the legal representative
2. A copy of the national ID card or passport of the applicant and the original for viewing
3. An original letter signed by the person concerned or who has the right to manage and sign in front of the competent employee, or the authenticity of a signature from the bank or signed by the legal agent (if this is expressly stated by the power of attorney) 
   To include the letter
   • The desire of the company or establishment to write off the agency contract to be written off
   • All contract data to be written off.
4. Delivery of all registration cards issued for the agency contract to be written off 
   In the event that one of them is lost, a lost note is brought, stamped from one of the police stations.
5. If the applicant is an agent of the facility or company, the following documents are required from him:
   • A copy of a notarized power of attorney from the real estate registry whose purpose is to write off the contract or contracts to be written off with a review of the original (even a second agent is accepted only)
   • Complete the declaration of validity of the power of attorney (original)
   • If he is a government employee, public authority, public institution, or local government unit, he submits a letter from his employer that there is no objection to that authority for the employee to work on behalf of others and that he is on leave without pay

B - Procedures for canceling the contract based on the agent’s request

1. Book an appointment through the GOEIC's website

2. Submitting the required documents in accordance with the provisions of Law No. 120 /1982
3. Document checking
4. Determining the value of the prescribed fees through the application receiving window
5. Pay the fees to the authority’s treasury with a visa
6. Financial and technical audit
7. Delete the agency card data
8. The agent reviews the card before wrapping it and receiving it (in case of other agency contracts)
9. Packaging and delivery

Second, documents and procedures for writing off or terminating the agency contract at the request of the principal

A- Documents for cancellation or termination of the agency contract at the request of the principal

• A letter notarized by the embassy and attested by the consulate in which the principal informs the authority of the termination of the agency contract registered with the authority

B- Procedures for writing off or ending the agency contract at the request of the principal (according to Law 120/1982).

1. The client notified the authority of the termination of the agency contract registered with the authority by a letter notarized by the embassy and certified by the consulate
2. The authority notifies the agent of the termination of the agency contract twice by registered letter with acknowledgment of receipt
3. If the agent does not submit a request to cancel the agency contract after notifying him twice, the procedures for canceling the agency shall be initiated by a decision of the competent authority.
4. If the agent submits a lawsuit or arbitration request to claim compensation within the 60 days from the date of the client’s termination of the agency contract, re-registration of the agency is prohibited until the case is decided upon and the compensation is settled
5. After the expiry of 60 days from the termination of the agency contract without the agent submitting a claim or an arbitration request for the claim, the agency can be re-registered to any new agent

Important Notes

3. It takes into account the placement of the stamp with 1 pound and the stamp of resource development on the power of attorney
4. If the person concerned or who has the right to manage and sign outside the country and delegate his legal representative to submit an application for obtaining the service at the authority, the power of attorney issued by a foreign authority must be certified by the Egyptian embassy or consulate abroad and deposited in the real estate registry in Egypt
5. It accepts even a second power of attorney only - the authorization is not accepted
6. If the person acting on behalf of the company in submitting the application is from the employees of the government, public authorities, public institutions or local government units, the agency card shall not be delivered until after notifying his employer
7. The presence of a valid agency contract affixed to the commercial agents registry card is one of the conditions for continued registration in the commercial agents registry 
   Thus, in the case of a single valid agency contract affixed to the commercial agents' registry card, the cancellation of this contract leads to the cancellation of the commercial agent's registration itself from the commercial agents' registry.
8. The agency contract may be written off in accordance with Article 30 bis of Regulation 82/342 if a decision or judgment is issued to that effect for a period not exceeding three years when
   • Termination of the contract without prior notice or at an inappropriate time, unless the termination is based on a serious and acceptable reason
   • Or the principal’s termination of the agency contract for an indefinite period without error or negligence on the part of the agent in implementing the contract
   • Or if the agent waived the agency at an inappropriate time and without an acceptable excuse
   • Or if the principal refrains from renewing the agency contract for a limited period without error or negligence on the part of the agent during the implementation of the agency contract
   • Or in the event of non-settlement of the compensations due, whether to the principal or the agent, arising from the agency contract
9. We ask you to be careful to avoid falling into the violations mentioned in Law 120/1982 and its Regulations 342/1982, which you decided to abide by with your personal statements.
10. After canceling the contract, the data of the customs dealers card must be updated from the customs computer
