Modify the register of real estate brokers

Service Description:

Amending the registration data of individual establishments and companies in the Real Estate Brokers Register in accordance with Law 120/1982

Types of modifications:

  • Modify the trade name or trademark
  • Amending the head office address and amending the commercial registration number
  • Amendment of the legal entity without the expiration of the legal personality
  • Amending the tax number or tax office
  • Adding or deleting an authorized agent in the individual properties
  • Entry or exit of a partner or modification of his capacity in companies
  • Amending who has the right to manage and sign
  • Add or delete a manager
  • Add or delete a branch
  • Amending the capital without being less than the minimum required according to Law 120/1982

Conditions required amending or recording the registration data in the Real Estate Brokers Register

First Conditions for amending or recording the data of individual establishments in the Real Estate Brokers Register

  1. That 90 days have not passed since the expiry date of the brokers registry card without renewing its validity
  2. That the natural personality has not expired due to the death of the person concerned the deletion of the commercial register, or the permanent suspension of the file at the Tax Authority.
  3. The real estate brokerage activity has not been written off from the commercial register or tax card
  4. The presence of a valid mediation contract affixed to the brokers registry card
  5. That no decision or judgment has been issued to cancel the establishment's registration in the real estate brokers registry for committing any of the violations mentioned in Law 120/1982 and its executive regulations

Second, the conditions for amending or recording companies’ data in the Real Estate Brokers Register

  1. That 90 days have not passed since the expiry date of the brokers registry card without renewing its validity
  2. That the legal personality has not expired and as a result the commercial register has been erased
  3. That the change of the legal entity did not result in the expiration of the legal personality
  4. That the real estate brokerage activity has not been written off from the commercial register or tax card
  5. The presence of a valid mediation contract affixed to the real estate brokers registry card
  6. If the company’s capital is not less than the required minimum (twenty thousand pounds) according to Law 120/1982
  7. If a decision or judgment has not been issued to cancel the registration of the facility or company in the real estate brokers registry for committing one of the violations mentioned in Law 120/1982 and its implementing regulations
  8. If one of the persons whose names are listed in the commercial register or the company has not undergone any change, he will lose any of the conditions of registration in the register of real estate brokers in accordance with Law 120/1982

Third, the conditions to be met by a person acting on behalf of a real estate broker

  1. He must be Egyptian
  2. He is entrusted under an official power of attorney documented by the real estate registry
  3. If the person acting on behalf of the real estate broker is among the employees of the government, public bodies, public institutions, or local government units, his employer must agree to represent the real estate broker before the commission

Documents required amending or recording the registration data in the Real Estate Brokers Register

First Documents to amend the registration of individual establishments in the Real Estate Brokers Register

  1. Complete the application for amending the real estate brokers, signed by the person concerned, in front of the competent employee or agent
  2. A copy of the national ID card or passport of the applicant for modification and the original for viewing
  3. A recent official extract from the commercial register, valid after noting the amendments
  4. A copy of the tax card with the amendments installed, provided that its data are complete and consistent with the data of the commercial register and the original for review
    Noting that in case of capital adjustment, the tax card copy will not be completed
  5. If the applicant is an agent on behalf of the person concerned, the following documents are required from him:
    • A copy of a notarized power of attorney from the real estate registry with a review of the original (only a second agent is accepted)
    • Complete the declaration of validity of the power of attorney (original)
    • If he is a government employee, public authority, public institution, or local government unit, he shall submit
    • A letter from his employer stating that this entity has no objection to the employee performing proxy work for others and that he has taken an unpaid leave
  6. In the event of changing the address of the company’s headquarters from one governorate to another
    The previous documents are to be completed in addition to the certificate of erasure of the old commercial register

Secondly, documents for amending company registration data in the Real Estate Brokers Register

  1. Complete the real estate brokers amendment request signed by the person who has the right to manage and sign in front of the competent employee or signed by the legal agent
  2. A copy of the national ID card or passport of the applicant for modification and the original for viewing
  3. A recent official extract from the commercial register, valid after noting the amendments
  4. A copy of the tax card with the amendments installed, provided that its data are complete and consistent with the data of the commercial register and the original for review
    Noting that in case of capital adjustment, the tax card copy will not be completed
  5. The amendment contract or the investment report that proves any of them the required amendments (original + copy)
    If the applicant is an agent for the company, the following documents are required from him:
  6. A copy of a notarized power of attorney from the real estate registry with a review of the original (even a second agent is accepted only)
  7. Complete the declaration of validity of the power of attorney (original)
  8. If he is a government employee, public authority, public institution, or local government unit, he shall submit
    A letter from his employer stating that this entity has no objection to the employee performing proxy work for others and that he has taken an unpaid leave
  9. In the event that the address of the company’s headquarters is modified from one governorate to another
    Documents 1 to 8 are completed in addition to
    Certificate of erasure of the old commercial register
  10. In the event of the entry of a general partner, members of the board of directors, or certain managers, or the capacity of a partner to be changed to a general partner, or who has the right to manage and sign, or to amend the chairman of the board of directors
    Documents 1 to 8 are completed in addition to
    • A copy of the national ID card or passport and the original for viewing
    • An official extract of the birth certificate or a copy of the military transaction
    • Noting that if he is of foreign origin, he must indicate on the birth certificate that more than ten years have passed since the acquisition of citizenship.
    • Acknowledgment form for the registration of the company in the register of real estate brokers, signed in front of the competent employee, or approval of the validity of the signature from the bank.
    • A decision accepting the resignation or termination of service if he was a former employee of the government, public bodies, public institutions, local government units, public sector companies or the public business sector, provided that two years have passed since he left work
  11. In the event of the entry of a limited partner or holders of shares
    Documents 1 to 8 are completed in addition to
    • A copy of the national ID card or passport and the original for viewing
    • An official extract of the birth certificate or a copy of the military transaction
      Noting that if he is of foreign origin, he must indicate on the birth certificate that more than ten years have passed since the acquisition of citizenship

Modification procedures

  1. Reserving an appointment through the GOEIC’s website (in case the application is submitted in MAROUF or October, or the Investor Services Complex at the Investment Authority)

  7. The person concerned or his agent shall review the card before wrapping it and receiving it

Important Notes

  3. It takes into account the placement of the stamp with 1 pound and the stamp of resource development on the power of attorney
  4. If the person concerned or who has the right to manage and sign outside the country and delegate his legal representative to submit an application for obtaining the service at the authority, the power of attorney issued by a foreign authority must be certified by the Egyptian embassy or consulate abroad and deposited in the real estate registry in Egypt
  5. It is not permissible to sign personal declarations on behalf of the mediator
    In the event that someone who fulfills the declaration travels outside the country, the declaration and a copy of the passport shall be documented from the Egyptian embassy or consulate abroad
  6. The validity of the declarations is 3 months, and until a second power of attorney is accepted only - the authorization is not accepted
  7. If the person acting on behalf of the amendment requester is a government employee, public authority, public institution, or local government unit, the real estate registry card is not delivered until after notifying his employer
  8. The number of contracts registered in the brokers record card is indicated
  9. Certification data and brokerage products include
    • The broker’s data, his name - the registration number on - the date of validity of the registration - the tax registration number
    • Principal data Registration code (authentication number at the embassy or consulate) - registration authority - client's name and nationality - contract certification number - contract start and end - contract validity (specified - automatic renewal - extended) - products subject of the contract
  10. If the intermediary is linked to a work contract with the producer, trader or distributor, the commercial intermediary shall pay half of the prescribed fees, and this shall be proven as follows:-
    If the contract is issued locally, it is submitted
    A copy of a certified work contract from the social insurance and the original insurance print for the mediator
    If the contract is issued from abroad, it is submitted
    A copy of an employment contract notarized by the competent chamber of commerce or the official authority that takes its place in the country of the foreign client and certified by the Egyptian consulate or embassy in the country of the foreign client
  11. The presence of a valid mediation contract affixed to the real estate brokers registry card is one of the conditions for continued registration in the real estate brokers registry
  12. In the event that there is only one valid brokerage contract installed on the real estate brokers registry card, its validity period is less than 5 years, the validity of the registration in the real estate brokers registry is linked to the expiry date of that contract until other brokerage contracts are added
