Real estate brokerage contract renewal

Service purpose

  • Amending the terms of the real estate brokerage contract in the real estate brokers registry in accordance with Law 120 of 1982
  • Renewing the mediation contract is considered an amendment to the validity clause of the contract

Conditions required to obtain the service

First, the conditions required to be met in the real estate brokerage contract

  1. No more than 30 days have passed since the date of documenting the contract annex, and the violation has not been repeated
  2. The annex to the contract must include a reference to the date of concluding the old contract or the date or number of the real estate month/embassy’s attestation on it
  3. The contract or its appendix must include the following:
    • The nature of the work of the real estate broker and his appointment of the real estate broker by the principal
    • Liability of the parties to the contract
    • Specifically for geographic area
    • The prescribed commission, the terms of its payment, and the type of currency in which it is paid
    • Specifically for the service scope, which is to determine the specifications of the real estate or services subject to the mediation contract
    • The principal’s ownership of the real estate, the trademarks it bears, or the services subject of the real estate brokerage contract
  4. If the contract or its appendix are issued by a foreign company or entity
    Any of them must include the commitment of the foreign company or entity to provide the competent Egyptian consulate with each agreement that includes an amendment to any statement of the contract data.
  5. In the event that a third party owns these real estate or the trademarks that bear them, the third party must agree to the principal’s use of the trademark and give the principal the right to delegate the third party
  6. If the contract or its appendix were issued locally by a sole proprietorship or company of persons or funds
    It must be notarized by the real estate registry
    If the contract or its appendix were issued locally by a public sector company
    It must be stamped with the company's Republic logo
    If the contract or its appendix are issued by a foreign company or entity
    The contract or its appendix must be notarized by the competent chamber of commerce or the official authority acting on its behalf in the country of the foreign client and certified by the Egyptian consulate or embassy in the country of the foreign client

Second, the conditions required to be fulfilled by the person acting on behalf of the mediator

  1. He must be Egyptian
  2. He is entrusted under an official power of attorney documented by the real estate registry
  3. If the person acting on behalf of the real estate broker is among the employees of the government, public bodies, public institutions or local government units
    His employer must agree to represent the real estate broker before the commission

Documents required obtaining the service

  1. Completion of the contract amendment request signed by the concerned employee, the person who has the right to administer and sign, or the agent
  2. A copy of the national ID card or passport of the applicant and the original for viewing
    If the applicant is an agent of the facility or company, the following documents are required from him:
  3. A copy of a notarized power of attorney from the real estate registry with a review of the original (even a second agent is accepted only)
  4. Complete the declaration of validity of the power of attorney (original)
  5. If he is a government employee, public authority, public institution, or local government unit, he shall submit
    A letter from his employer stating that this entity has no objection to the employee performing proxy work for others and that he has taken an unpaid leave
  6. An official certified copy of the appendix of the real estate brokerage contract or an official letter approved by the client authenticated with the required amendments
    Provided that either of them has a reference to the date of concluding the old contract, the date of its ratification, or the ratification number
    Who fulfills the conditions for registering real estate brokerage contracts (as previously mentioned in the item “First of the conditions required to be met in the real estate brokerage contract”)
  7. If the contract was issued by a foreign company or entity and in the foreign language only, it shall be submitted:
    The original translation of the real estate brokerage contract according to the established rules regarding translation
  8. In the event of adding real estate or trademarks to the real estate owned by the principal and this is not expressly provided for in the real estate brokerage contract, one of the following documents shall be submitted
    (With its authentication from the Egyptian real estate registry or from the competent authority in the country of the client or from the competent chamber of commerce and certified by the Egyptian consulate or embassy in the country of the foreign client)
    An appendix to the contract stating that the trademarks are owned by the principal
    Or a trademark registration certificate from the competent department in the country of the client
  9. If the added real estate or the trademarks you carry are owned by a third party,
    • A relationship letter between the principal and the third party, authenticated by the third party’s country, that includes:
      • Third party trademark ownership
      • The third party’s consent to the principal’s use of the trademark and giving him the right to delegate a third party
    • If the letter of the relationship between the principal and the third party does not state that the third party owns the trademark, it shall be submitted with the letter.

Important Notes :

It takes into account placing the stamp with 1 pound and the resource development stamp on the brokerage contracts, their amendments, their translation, any appendix to the contract, the trademark registration certificate, the relationship letter between the principal and the third party, the companies’ articles of incorporation and their amendments, and the power of attorney
  4. If the person concerned or who has the right to manage and sign is outside the country and delegate his legal representative to submit an application for obtaining the service at the authority, the power of attorney issued by a foreign authority must be certified by the Egyptian embassy or consulate abroad and deposited in the real estate registry in Egypt
  5. The validity of the declarations is 3 months, and a second power of attorney is accepted only - the authorization is not accepted
  6. If the person acting on behalf of the company in submitting the application is from government employees, public authorities, public institutions or local government units, the card shall not be delivered until after notifying his employer
  7. If the contract contains a reference to the date of an old contract, it is considered a renewal or modification of the contract, and it is not considered a new contract that is required to be added
  8. Renewing the contract with an official letter from the client notarized, indicating the date of concluding the old contract, the date of its ratification, or the embassy’s ratification number.
  9. If the service and geographical scope is specified in the contract, the real estate brokerage contract appendix, or the official letter from the principal, that scope shall be specified in the real estate brokers registry card.
  10. The number of registered contracts, data certificate and real estate brokerage contract products are indicated in the real estate broker's registry card.
  11. Real estate brokerage data and products certification guarantee
    • The data of the real estate broker, his name - registration number - the date of validity of the registration - tax registration number
    • Principal data Registration code (authentication number at the embassy or consulate) - Registration authority - Client name and nationality - Contract annex certification number - Contract start and end - Validity of contract addendum (specified - automatic renewal - extended) - Products subject of the contract
  12. Agency contracts translation
    • If the contract submitted for registration is issued in two languages, one of which is Arabic, with the same authentication and approval, it is sufficient to submit a copy of that contract after perusal of the original without the need to translate it locally.
    • If the contract is issued in the English language only or in more than one foreign language, including English, it shall be translated at any approved center that provides the original translation.
    • If the contract was issued in a foreign language - other than English - it is translated by a government agency (such as the Ministry of Justice - College of Al-Al sun - a university ... etc.) The original translation is submitted
  13. If the contract, its appendix or the official letter of amendment were issued by a country in which we do not have diplomatic representation, the following shall be done:
    • It is certified by the Chamber of Commerce in that country
    • It is accredited in the nearest Arab consulate that has a diplomatic representation in that country
    • It is certified by the embassy of that Arab country in Egypt
    • The seal of the embassy is ratified by the Egyptian Foreign Ministry
    • In this case, the contract must include the foreign principal's obligation to notify the General organization for Export and Import Control of any modification or change that occurs to the contract.
  14. If the intermediary is linked to a work contract with the producer, trader or distributor, the commercial intermediary shall pay half of the prescribed fees, and this shall be proven as follows:-
    If the contract, its appendix, or the official letter of amendment is issued locally, it shall be submitted
    A copy of a certified work contract from the social insurance and the original insurance print for the mediator
    If the contract, its appendix or the official letter of amendment is issued from abroad, it shall be submitted
    A copy of an employment contract notarized by the competent chamber of commerce or the official authority that takes its place in the country of the foreign client and certified by the Egyptian embassy or consulate in the country of the client
  15. The presence of a valid agency contract affixed to the real estate brokers registry card is one of the conditions for continued registration in the real estate brokers registry
  16. In the event that there is only one valid agency contract installed on the real estate brokers registry card, the validity period of which is less than 5 years, the validity of the registration in the real estate brokers registry is related to the expiry date of that contract until other agency contracts are added
  17. The agent shall notify the Authority of every amendment in the data relating to the real estate brokerage entrusted to him within 30 days from the date of documenting the amendment contract.
    If the authority is not notified within 30 days, the following measures shall be taken in accordance with Article 21 of Law 1982/120.
    • Forfeits the right of the establishment to insurance
    • The Authority shall notify the establishment of the forfeiture of its right to insurance by registered letter with acknowledgment of receipt at its last address of which the Authority was notified
    • The facility shall pay double insurance within thirty days from the date of being notified of the forfeiture of its right to insurance
    • In the event of a repetition of the violation, the registration shall be canceled by a decision of the Minister of Economy and the right to recover the double insurance shall be forfeited.
    • The agent has the right to recover the double insurance if he does not repeat the breach
  18. After amending the contract and to start practicing the agency’s activity with this contract, the data of the customs dealers card must be updated from the customs computer, the car customs at Cairo Airport
  19. We ask you to be careful to avoid falling into the violations mentioned in Law 120/1982 and its Regulations 342/1982, which you decided to abide by with your personal statements
