Refund of insurance in case of administrative write-off of the importers register

Recovering insurance in cases of administrative write-off in accordance with Law 121/82 and amended by Law 7 of 2017

When is the administrative write-off?

  1. If more than 90 days have passed since the expiry of the importers registry card without renewing its validity
  2. If the situation is not reconciled according to Law 7/2017 in the period specified for that and ended on 08/15/2018.
  3. If the commercial registry is erased due to the expiry of the legal or natural personality.
  4. If the legal entity is modified and this results in the expiration of the legal personality.
  5. If the natural personality expires due to the death of the person concerned.
  6. If the file at the Tax Authority is permanently suspended due to the expiration of the legal or natural personality.
  7. If the head office fixed in the commercial registry is changed from one governorate to another.
  8. If the import activity is written off from the commercial register
  9. If the capital is modified to be less than the legally established minimum.
  10. If the capital owned by Egyptians is less than 51% of the paid-up capital in the companies.

Action taken in the event of an administrative write off

  1. Determining the cases due for administrative write-off and reviewing the file.
  2. Preparing and approving a write-off note.3. Recording the final delisting decision.
  3. Recording the final delisting decision.
  4. The insurance recovery procedures shall not be proceeded until after the final write-off decision is issued.

Insurance refund conditions and required documents

  1. Issuance of the final cancellation decision and its registration on the system.
  2. There are no open shipments in process.

Documents required to recover insurance upon administrative write-off

  1. The original form of “Request for Insurance Refund for Administratively Written Cards” signed by the person. concerned, and I grant him the right to administer and sign according to the last commercial record in the file with the signature in front of the competent employee or the authenticity of a signature from the bank.
  2. The original “Declaration of Insurance Refund for Written Cards” signed by the person concerned or who has the right to administer and sign according to the last commercial record on file with the signature in front of the competent employee or the authenticity of a signature from the bank.
  3. A copy of the national ID card or passport of the owner of the facility, I believe in him the right to manage, sign and the original for viewing.
  4. Bring all copies of valid importers record cards issued to the facility / company or a police report of their loss or the loss of any of them.
  5. A copy of the receipt for the collection of the insurance amount to be recovered (if any) or a copy of the letter of guarantee (if any)
    If the applicant is an agent submit
  6. A copy of a notarized power of attorney from the real estate registry and the original for perusal for the purpose of recovering the insurance (even a second agent is accepted only)
  7. A copy of the national ID card or passport of the agent and the original for viewing.
  8. Acknowledgment of the validity of the power of attorney signed by the agent (if the applicant for cancellation is an agent).
  9. An original letter from the bank with the account number to which the insurance will be transferred, provided that it is a bank approved by the electronic payment system of the Ministry of Finance with the same name and commercial name issued in its name, the insurance in the file.
  10. In the event of the death of the person concerned in the sole proprietorship.
    In addition to the documents from 4 to 8, the following must be fulfilled-
    • “Request for insurance recovery for administratively written off cards” signed by all the heirs, with a valid signature from the bank, or the signature of the heirs in front of the competent employee
    • Original death certificate

    • Declaration of Wills (for minors from the court)
    • A copy of the identity document for the heirs
    • A letter from the bank with the account number for each heir to whom the insurance will be transferred, provided that he is a bank approved by the electronic payment system of the Ministry of Finance.
  11. In the case of filtering
    In addition to the documents from 4 to 8, the following must be fulfilled-
    • Request for a visa to erase the commercial register or trade register in liquidation.
    • The liquidation contract or the minutes of the general assembly meeting in the liquidation.
    • "Request to recover insurance for administratively written off cards" in the name of the liquidator, with a valid signature from the bank, or the liquidator's signature in front of the competent employee.
    • A copy of the identity card for the liquidator and the original for viewing.
    • A letter from the bank with the number of the liquidation account to which the insurance will be transferred, provided that it is a bank approved by the electronic payment system of the Ministry of Finance, noting that the liquidator signs the power of attorney instead of the person concerned for the duration of the liquidation period.
  12. In the event of the company's dissolution
    In addition to the documents from 1 to 8, the following will be fulfilled.
    • Request for a visa to erase the commercial register
    • Minutes of the non-general meeting or the termination contract.
    • A waiver of the insurance amount for the partner submitting the refund request from the rest of the partners, provided that they sign it in front of the competent employee or the validity of their signature from the bank.
    • A letter from the bank with the account number of the partner assigning the insurance amount to be transferred to the insurance, provided that it is a bank approved by the electronic payment system of the Ministry of Finance.

Actions taken to recover insurance in case of administrative write-off

  1. Book an appointment through Goeic’s website (in case the application is submitted with a favor - October - the office of the Investors Services Complex in the General Investment Authority only)

  2. Ensure that the final delisting decision is issued and recorded on the system
  3. Ensure that there are no messages under process or a ban on the transaction number
  4. Reviewing the file to ensure that there is no legal obstacle to the refund and to ensure that the insurance has not been previously refunded.
  5. Preparing the insurance recovery file.
  6. Send the insurance refund request and attachments to the Financial Affairs for review.
  7. Financial and technical review of the application and attachments.
  8. Completing the financial cycle to recover the insurance and transfer the amount to the client's account.

  • Only a second agent is accepted and does not accept dealing with authorization in the importers registry.
  • If the person concerned or who has the right to manage and sign outside the country and delegate his legal representative to submit an application for obtaining the service at the authority, the power of attorney issued by a foreign authority must be certified by the Egyptian embassy or consulate abroad and deposited in the real estate registry in Egypt.
  • Insurance recovery procedures are not proceeded before the administrative write-off decision is issued and registered on the system
  • To obtain a certificate stating that the facility or company has been written off, you can request a data certificate.
  • After writing off the importers record card, this must be proven in the customs at the customs computer - Car Customs at Cairo International Airport.
  • The presence of open shipments under the procedures that prevents the recovery of the insurance for the failure to complete the procedures of any customs certificate (exported or imported) prior to which the conformity has not been received or the risks of rejection to the system.

  • The tax card may be prohibited due to a violation of Article 86 or Article 96 of Regulation 770/2005, which prevents the recovery of insurance until the reasons for the ban are removed and the ban is lifted.
  • Legal obstacle that may prevent insurance recovery
    • If it is proven in the file that the facility or company has previously notified the Authority of any amendment to the registration data in the importers register 60 days after the occurrence of that amendment.
    • The action taken in the event of a legal impediment, the decision on recovering the insurance is postponed until the public prosecution responds .

    • Issuance of the final cancellation decision and its registration on the system.
    • There are no open shipments in process

    • In the event that it is proven that Goeic has not been notified of any amendment to the registration data in the importers register after 60 days from the occurrence of such amendment, it is possible to inquire about the absence of a legal obstacle preventing the recovery of the insurance.
    • Ensure that the account number to which the insurance will be transferred is approved by the electronic payment system of the Ministry of Finance.
  • The establishment/company may not be re-registered except after the cancellation decision has been issued and registered on the system.
  • Crossing out the entry in the importers register leads to a ban on the tax card. In the event that any other activity in the tax card (other than import) continues, you can contact the call center 19591 or visit the Customer's Service Office at the airport
